All content, software, design, logos, and other materials on MapMyVisitors.com are the property of MapMyVisitors, Inc. or its licensors, and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our materials without prior written permission.
You retain all rights to your own website content. By using the Service, you grant us a limited, non-exclusive license to process data from your website solely for the purpose of providing the Service.
The geographic data provided by the Service is based on IP-to-location lookups and represents approximate locations only. We do not guarantee the accuracy, completeness, or timeliness of any geolocation data. The Service should not be used as the sole basis for any decision that requires precise geographic information.
Visitor counts and statistics are estimates and may be affected by factors including but not limited to: bot traffic filtering, VPN usage, shared IP addresses, caching, and ad blockers.
We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of scheduled downtime.
You may cancel your account at any time through your account settings or by contacting us. Upon cancellation, your access to paid features will continue until the end of the current billing period.
We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if we are required to do so by law. We will make reasonable efforts to notify you before termination, except where immediate action is necessary to protect the Service or other users.
Upon termination, your right to use the Service ceases immediately. We may delete your account data and visitor statistics after a reasonable retention period, unless we are required to retain certain data by law.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT GEOLOCATION DATA WILL BE ACCURATE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAPMYVISITORS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.
You agree to indemnify and hold harmless MapMyVisitors, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of: (a) your violation of these Terms; (b) your use of the Service; (c) your failure to obtain necessary consents from your website visitors; or (d) your violation of any applicable law or third-party rights.
We may modify these Terms at any time. Material changes will be communicated via email to registered users or by a prominent notice on our website at least 30 days before they take effect. Your continued use of the Service after the effective date of the changes constitutes your acceptance of the updated Terms. If you do not agree to the changes, you should stop using the Service and cancel your account.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
Nothing in these Terms shall limit the rights of consumers under mandatory provisions of the consumer protection laws of their country of residence.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MapMyVisitors regarding the use of the Service, and supersede any prior agreements or understandings.
